FEBRUARY 2012

• NOTICE OF PUBLIC HEARING BEFORE THE COLORADO AIR QUALITY CONTROL COMMISSION to consider the Pikes Peak Area Council of Governments (PPACG) conformity determinations associated with its 2035 Moving Forward Regional Transportation Plan and 2012-2017 Transportation Improvement Program.

• NOTICE OF WRITTEN COMMENT ONLY RULEMAKING HEARING BEFORE THE COLORADO AIR QUALITY CONTROL COMMISSION to consider a proposal by the Division to revise Regulation Number 6, Part A (NSPS) to incorporate by reference changes the U.S. Environmental Protection Agency made to its New Source Performance Standards rules and Emission Guidelines in 40 CFR Part 60.   All of the proposed revisions are specific to existing NSPS and Emission Guidelines.  Further, these revisions will include any typographical, grammatical and formatting errors throughout the regulation.

• NOTICE OF PUBLIC RULEMAKING HEARING BEFORE THE COLORADO AIR QUALITY CONTROL COMMISSION to consider revisions to Regulation Number 9 regarding a periodic update in each permittees recent emissions and permitting activity data. This data is used to determine the distribution of the cost of the smoke management program to each permittee.

• NOTICE OF PUBLIC RULEMAKING HEARING BEFORE THE COLORADO AIR QUALITY CONTROL COMMISSION to consider streamlining the transportation conformity process by allowing the Colorado Air Pollution Control Division to provide concurrence with routine transportation conformity determinations without the need for a public hearing before the Colorado Air Quality Control Commission.  This change to the conformity process is allowed for under federal law and will reduce the burden on the AQCC, the Division and transportation planning organizations, while ensuring that air quality requirements are met.  The Commission will consider proposed revisions to the AQCC’s Regulation Number 10 and the Procedural Rules, governing conformity determinations in Colorado.

• NOTICE OF PUBLIC RULEMAKING HEARING BEFORE THE COLORADO AIR QUALITY CONTROL COMMISSION to consider a proposed revision to the Interstate Transport State Implementation Plan (SIP) for the 2006 PM2.5 standard.  This revision is a supplement to previously-approved chapters of the Interstate Transport SIP that the Commission approved in January 2010 and December 2008, which focused on the 1997 ozone and PM2.5 standards.

• NOTICE OF PUBLIC RULEMAKING HEARING BEFORE THE COLORADO AIR QUALITY CONTROL COMMISSION to consider a proposed revised PM10 Maintenance Plan for the Steamboat Springs Attainment/Maintenance Area.  Approval of the associated documents by both the City of Steamboat Springs and Routt County is anticipated by December 2011.  Additionally, a change to the “Air Quality Standards – Air Quality Standards, Designations and Emission Budgets” regulation is proposed to update the PM10 emission budget for the Steamboat Springs area.

• NOTICE OF PUBLIC COMMENT HEARING BEFORE THE COLORADO AIR QUALITY CONTROL COMMISSION pursuant to the request of CF&I Steel, L.P. d/b/a/ EVRAZ Rocky Mountain Steel (ERMS) and the provisions of Section 25-7-114.5 Colorado Revised Statutes to consider the initial approval modification of the Construction Permits for the facility located at 2100 South Freeway in Pueblo Colorado.  Section 25-7-114.5 Colorado Revised Statutes provides an opportunity for the applicant or interested parties to request a public hearing before the Commission to seek the comments of any interested person regarding the adequacy of the preliminary analysis and whether the permit(s) should be approved or denied.  The draft operating permit(s) and preliminary analysis’ (i.e. Technical Review Documents) can be viewed at the Office of the Pueblo County Clerk and Recorder at 215 West 10^th Street, Pueblo, Colorado, 81003, Phone: 719-583-6507 during regular business hours or at the offices of the Colorado Department of Public Health and Environment, Air Pollution Control Division at 4300 Cherry Creek Drive South, Glendale, Colorado 80246.  This information is also available on the Department of Public Health and Environment’s website at http://www.cdphe.state.co.us/ap/airpublicnotices.html

• NOTICE OF PUBLIC RULEMAKING HEARING BEFORE THE COLORADO AIR QUALITY CONTROL COMMISSION to consider revisions Regulation Number 12, Part A to establish emissions exemption and enforcement procedures for fleet-owned heavy-duty diesel vehicles based outside the program area as part of a fleet registered in the program area, pursuant to the passage of HB 11-1157.

• NOTICE OF PUBLIC HEARING BEFORE THE COLORADO AIR QUALITY CONTROL COMMISSION to consider the NFRMPO's conformity determinations.

• NOTICE OF PUBLIC RULEMAKING HEARING BEFORE THE COLORADO AIR QUALITY CONTROL COMMISSION to consider whether the Estes Park area should continue to be included in the Enhanced North Front Range Automobile Inspection and Maintenance (I/M) program.  The Division is also requesting technical modifications to Regulation Number 11, Part A, Section V.A. to clarify that the emissions program would apply to Estes Park area vehicles commencing with January 2012 registration renewals.

• NOTICE OF PUBLIC HEARING BEFORE THE COLORADO AIR QUALITY CONTROL COMMISSION to consider DRCOG conformity determinations associated with its Cycle I Amendments to its 2012-2017 Transportation Improvement Program and 2035 Regional Transportation Plan to the8-Hour Ozone SIP, Denver and Longmont Carbon Monoxide Maintenance Plans, and the Denver PM10 SIP.
