Division of Environmental Health and SustainabilityBody ArtThe Body Art program was established by authority of the Colorado Body Art Act on May 23, 2000. This act allowed the Colorado Department of Public Health and Environment, in conjunction with local health agencies, body artists and the staff of the Division of Environmental Health and Sustainability, to assemble regulations for body art businesses statewide. The "Rules and Regulations for Body Art Establishments" was subsequently adopted by the Colorado Board of Health at their meeting on July 18, 2001, and became effective on August 30, 2001. The primary purpose of the Body Art Act, and consequently, the regulations that it created, was to ensure "the safe and sanitary practice of body art, the safe and sanitary physical environment where body art is performed and the safe and sanitary conditions of equipment utilized in body art procedures." Among the conditions included in the regulations are age and consent requirements for minors. These state that body artists cannot perform body art procedures on anyone under the age of eighteen unless they have received prior consent from the child's parent or guardian. Although the State’s regulations do apply to every body art business in Colorado, local health agencies may also choose to institute their own regulatory programs, and invoke requirements that are more stringent. Additionally, they may also choose to recover their program costs by assessing an inspection and/or license fee.
