Air Pollution Control DivisionLocal Residential Burning Program StatusColorado Air Quality Control Commission Regulation No. 4 prohibits the use of uncertified devices on air quality Action Days during the annual High Pollution Season (Nov. 1 - March 31). Uncertified devices include traditional fireplaces and any uncertified stove or insert. Regulation No. 4 applies to all residential dwellings in the seven-county Denver-metropolitan area, which includes the counties of Denver, Broomfield, Boulder, Jefferson, Douglas, Adams and Arapahoe. Exempt areas in the Denver-metropolitan area include those locations above 7,000 feet in elevation or east of Kiowa Creek in Adams and Arapahoe Counties. However, if you live in an area listed below that has a mandatory ban, your local government has jurisdiction and is responsible for enforcement. If you live in an area that lists a voluntary ban, or no ban, residential burning on air quality Action Days still is illegal. The State of Colorado has jurisdiction and enforcement responsibilities in those areas.
