Colorado Compliance Advisory Panel
The 1990 Clean Air Act Amendments
required each state to form a Compliance Advisory Panel (CAP) to monitor the effectiveness of the
Small Business Assistance Program (SBAP).
The Compliance Advisory Panel (CAP) is a legislatively appointed body consisting of at least seven members whose function is to review, assist, and advise Colorado's Air Quality Small Business Assistance Program. The statutes define the mission of the CAP and tend to be written in broad general terms to allow flexibility from state to state in the manner in which the CAP interacts with the Ombudsman and the
SBAP.
Role of the Colorado Compliance Advisory Panel
(CAP)
- Evaluate the effectiveness and direction of the
Small Business Assistance Program (SBAP);
- Act as an
intermediary to bring small
business issues to the attention of the
SBAP, legislatures, trade organizations, commissions
(e.g., Air Quality Control Commission), National Steering Committees, and other advisory
groups like the Pollution Prevention
Advisory Board (PPAB);
- Assist the SBAP in providing compliance information and technical,
mulit-media, and pollution prevention assistance
to small businesses; and
- Assist the SBAP in developing ideas and approaches; establishing
industry contacts; prioritizing
projects; and reviewing educational material.

National Compliance Advisory Panel
In 2001, the National Compliance Advisory Panel
(NCAP) was formed to foster effective working relationships among the various
state Compliance Advisory Panels, and also to foster an
effective working relationship with the US EPA.
The NCAP consists of one representative from each
US EPA region, the Small Business
Ombudsman/Small Business Assistance Program Steering Committee
chairperson, and various US EPA
representatives appointed by the US EPA.
The
role of the National Compliance Advisory Panel
(CAP) is to:
- Provide information to the
US EPA Small Business Ombudsman (SBO)
regarding the state CAPs and environmental issues affecting small
business;
- Disseminate information between the SBO and the state
CAPs;
- Review existing and proposed
US EPA rules affecting small businesses;
and
- Assist the states in the formation and function of the
CAPs.
