Criteria and Non-Criteria Reportable Pollutants
Stationary Sources Program

Sources emitting Criteria or Non-Criteria Reportable Pollutants above certain thresholds are required to submit an Air Pollutant Emission Notice (APEN) to the Stationary Source Program, Construction Permit Unit .  APEN and air permitting requirements are defined in Regulation No. 3, Air Pollution Emissions Notices .    


Criteria Pollutants  

Reporting Requirements:  For criteria pollutants (Reg. No. 3, II.B.3a), air pollutant emission notices (APENs) are required for:

  • Each individual emission point in a nonattainment are with uncontrolled actual emissions of one ton per year or more of any individual criteria pollutant (pollutants are not summed) for which the area is in nonattainment;

  • Each individual emission point in an attainment area with uncontrolled actual emissions of two tons per year or more of any individual criteria pollutant (pollutants are not summed);

  • Each individual emission point with uncontrolled actual emissions of lead greater than one hundred pounds per year, regardless of where the source is located.

Criteria Pollutants include:  Carbon monoxide, nitrogen oxides, sulfur dioxide, PM10, total suspended particulates, ozone, volatile organic compounds, lead, fluorides, sulfuric acid mist, hydrogen sulfide, total reduced sulfur, reduced sulfur compounds, municipal waste combustor organics, municipal waste combustor metals, and municipal waste combustor acid gases.

Reporting Form:  Criteria pollutants are reported using the Air Pollutant Emission Notice (APEN) form.  APENs are downloadable , and completed forms should be submitted to the Construction Permit Unit .

  Non-Criteria Reportable Pollutants  

Reporting Requirements:  For non-criteria reportable pollutants (Reg. No. 3, II.B.3b), air pollutant emission notices (APENs) are required for:

  • Each individual emission point with uncontrolled actual emissions that exceed the de minimis levels as determined following the procedures set forth in Reg. 3, Appendix A .

Non-Criteria Reportable Pollutants include:  All pollutants listed in Reg. 3, Appendix B .  

Reporting Form:  Non-Criteria Reportable pollutants are reported using the Air Pollutant Emission Notice (APEN) Addendum for Non-Criteria Reportable Pollutants form.  This form is downloadable , and completed forms should be submitted to the Construction Permit Unit .
